2. Business activity

Software design and maintenance. In relation to golfactive.eu: providing golf clubs with a course navigation application and producing cartographic representations of golf courses.

The activity requires no licence or entry in a register of regulated activities, and is not a regulated profession within the meaning of Directive 2005/36/EC. No professional body rules, professional titles or codes of professional conduct apply.

The website and the application are hosted on Cloudflare Pages:

For traffic originating in the European Union, standard contractual clauses (Commission Implementing Decision (EU) 2021/914) and EU-US Data Privacy Framework certification apply.

4. Intellectual property

4.1. Website and application

All rights in the golfactive.eu website and the Golf Active application — source code, interface, layout, texts, icons and the "golfactive.eu" name and logo — belong to SELKANO KANIEWSKI SP.J. Reproduction, distribution and adaptation without consent are prohibited beyond the limits of permitted use.

4.2. Basemap

Basemap data come from the OpenStreetMap project and are provided under the Open Database License (ODbL) 1.0:

Tiles are served by the OpenStreetMap Foundation in accordance with its Tile Usage Policy. The attribution is displayed in the application interface and may not be removed.

4.3. Golf course geometry

The vector representation of a course (fairways, greens, bunkers, water bodies, paths, play axis, hole model) is produced from the course plan supplied by the club. It constitutes a derivative work and a protected database.

• Rights in the course plan, scorecard, photographs and club trade marks belong to the golf club concerned and are used under licence.
• Rights in the vectorisation and the course model belong to SELKANO KANIEWSKI SP.J.

The geometry is not a surveying measurement. It may not be used for design, land registry, insurance or any other purpose requiring official data.

4.4. Photographs

Facility photographs and presentation materials are supplied by golf clubs or licensed from stock libraries. The demonstration material on golfactive.eu is based on the course plan of Sierra Golf Resort and serves solely to show how the application works.

6. Consumers and dispute resolution

The service is provided to players free of charge; paid contracts are concluded exclusively with golf clubs, that is with businesses.

• We are not obliged to participate in proceedings before a consumer ADR body and do not undertake to participate in such proceedings. This does not affect our willingness to settle matters amicably.
• Complaints: hello@golfactive.eu; procedure and deadlines in section 11 of the Terms of Use.
• The European ODR platform no longer exists — it ceased operating on 20 July 2025 (Regulation (EU) 2024/3228). The European Commission maintains a list of national ADR bodies.

7. Data protection

Processing is described in the Privacy Policy; device storage in the Cookie and Local Storage Policy.

No Data Protection Officer has been appointed (no condition in Article 37(1) GDPR is met). Data protection contact: hello@golfactive.eu.

Lead supervisory authority: President of the Personal Data Protection Office (UODO), ul. Stawki 2, 00-193 Warsaw, Poland. You may also complain to the authority of your country of habitual residence (Article 77 GDPR) — including the ICO in the United Kingdom and the DPC in Ireland.
